Sports centre director to be prosecuted for pension fraud

The company director of an East Sussex-based sports centre is to be prosecuted for allegedly fraudulently evading his duty to pay employee pensions contributions.

In a note from The Pensions Regulator today (March 1), it accused Lee Bartholomew, 44, from Kent, of fraudulently deducting money from the salaries of employees of 1066 Target Sports Ltd.

TPR said he deducted the money as contributions towards the company’s occupational pension scheme but did not pay it to the schemes within a prescribed period. 

The prosecution is being brought by The Pensions Regulator.

Bartholomew has also been charged with failure to provide information requested under sections 72 and 77 of the Pensions Act 2004.

He has been summoned to appear at Brighton Magistrates’ Court on March 24, 2023.

According to the Pensions Act 1995, it is a criminal offence for employers to deduct money from their employees' salaries as contributions towards an occupational pension scheme and not pay it to the scheme trustees within a prescribed period.

Under the Pensions Act 2004, TPR has the power to compel information from individuals and corporations by issuing a section 72 notice.
